1. Acceptance of Terms

By downloading, installing, or using the Bindfy application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Bindfy ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of the updated Terms.

2. Description of Service

Bindfy provides a digital loyalty stamp card platform that enables:

• Businesses ("Companies"): To create and manage digital loyalty stamp card programs for their customers.
• Consumers ("Customers"): To discover participating businesses, collect digital stamps, and redeem loyalty rewards.

The App connects Companies and Customers through QR code-based stamp collection and a digital card management system.

3. User Accounts

3.1 Registration

To use the App, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Types

The App supports two account types: Company accounts (for businesses) and Customer accounts (for individuals). Each account type has different features and responsibilities as described in these Terms.

3.3 Account Security

You agree to immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with this security obligation.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Transmit any viruses, malware, or other harmful code
• Collect or harvest any personally identifiable information from other users without consent
• Misrepresent your identity or affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the App
• Create fraudulent stamp collections or loyalty transactions

5. Company Responsibilities

If you register as a Company, you additionally agree to:

• Provide accurate business information in your profile
• Honor all loyalty rewards advertised to customers through the platform
• Maintain appropriate staff training for using the stamp scanning feature
• Comply with all applicable consumer protection laws and regulations
• Not manipulate stamp counts or deceive customers

6. Intellectual Property

The App, including all content, features, and functionality, is owned by Bindfy and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

You retain ownership of any content you upload to the App (such as business logos or profile images), but grant us a worldwide, royalty-free license to use such content for the purpose of operating and improving the App.

7. Privacy and Data

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

We implement industry-standard security measures to protect your personal data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

8. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BINDFY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL BINDFY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease.

You may delete your account at any time through the App settings. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy and applicable law.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after such notification constitutes your acceptance of the updated Terms.
